Terms of Service

HouseMunny is operated by an individual under Portuguese sole proprietorship law. All legal obligations and liabilities lie with the developer in accordance with applicable Portuguese regulations.

Please read these Terms of Service ("Terms") carefully before using the HouseMunny website, mobile applications, and services (collectively, the "Service") operated by HouseMunny ("we", "us", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Age Requirement: You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this requirement.

1. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

2. Subscriptions and Payments

Access to the HouseMunny Service is available only through a paid subscription. By subscribing, you agree to the following terms:

  • Subscription fees are billed at the beginning of each subscription period
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing cycle
  • You authorize recurring charges to your selected payment method for each renewal period
  • Any changes to subscription pricing will apply starting from the next billing cycle
  • You may cancel your subscription at any time through your account settings. After cancellation, you will retain access to the paid features until the end of your current billing period

Refund Policy

Refunds are generally not issued except in the case of billing errors, unless otherwise required by applicable law. EU consumers may have a 14-day cooling-off period under local consumer protection laws. To request a refund, contact guilherme@housemunny.com.

Payment Processing

All payments are securely processed by Stripe, a third-party payment processor. Your payment information is handled exclusively by Stripe and is not stored on our servers. By using HouseMunny, you also agree to be bound by Stripe's Terms of Service and Privacy Policy.

3. Acceptable Use

You agree not to use the Service for any purpose that is illegal or prohibited by these Terms. You may not use the Service in any manner that could damage, disable, overburden, or impair the Service.

You agree not to:

  • Use the Service to upload, transmit, or distribute any content that is illegal, harmful, threatening, abusive, or invasive of another's privacy
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • Engage in any activity that interferes with or disrupts the Service
  • Attempt to access any portion of the Service that you are not authorized to access
  • Use any robot, spider, or other automated means to access the Service
  • Reverse engineer or attempt to extract the source code of the Service

4. Content and Data

Our Service allows you to input, import, and store financial information. You retain all rights to your data, and you are responsible for all data you provide to the Service.

You grant us a non-exclusive, royalty-free, worldwide license to use, store, and process your data solely for the purposes of operating, improving, and securing the Service. We will not access your data except in the following situations:

  • To provide and maintain the Service
  • To respond to your requests for customer service or technical support
  • As required by law or to comply with legal process
  • To protect our rights, privacy, safety, or property
  • To protect against potential fraud or illegal activity

We may use aggregated, anonymized data for analytical purposes, product improvement, and other legitimate business purposes.

AI-Powered Features: We use artificial intelligence services, including OpenAI's API, to automatically categorize transactions imported from your connected bank accounts (via Plaid) based on transaction labels for your convenience. This feature only applies to bank-imported transactions; manually added transactions are not processed through AI. These automatic categorizations are provided to save you time and are not guaranteed to be accurate. You retain full control over all categorization decisions and can review, modify, or change any AI-assigned category at any time. AI categorization does not constitute financial advice or automated decision-making with legal effects.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of HouseMunny and its licensors. The Service is protected by copyright, trademark, and other laws of Portugal and the European Union.

Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

6. Disclaimers

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We make no warranty that:

  • The Service will meet your requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results that may be obtained from the use of the Service will be accurate or reliable
  • Any errors in the Service will be corrected

We do not provide financial advice, and the Service should not be used as a substitute for professional financial advice. You should consult with a qualified financial advisor before making any financial decisions.

Service Availability: Downtime may occur occasionally for maintenance, updates, or due to circumstances beyond our control. Users are not entitled to compensation for service outages or interruptions.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you paid to us during the twelve (12) month period preceding the event giving rise to the liability.

8. Indemnification

You agree to defend, indemnify, and hold harmless HouseMunny and its licensors, service providers, and their respective officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

9. Intellectual Property Infringement

If you believe your intellectual property rights have been infringed by content on the Service, please contact us at guilherme@housemunny.com with all relevant details. We will investigate and take appropriate action in accordance with applicable law.

10. Third-Party Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by HouseMunny. We do not endorse or assume any responsibility for any such third-party sites, information, materials, products, or services.

If you access any third-party website, service, or content from the Service, you do so at your own risk, and you agree that HouseMunny will not be responsible for any loss or damage that you may suffer as a result of your use of any third-party services.

11. Force Majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to natural disasters, internet outages, acts of government, civil unrest, or other force majeure events.

12. Termination

We may terminate or suspend your account and access to the Service if you breach these Terms or misuse the Service. In most cases, we will provide notice and an opportunity to resolve the issue before taking action.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may simply discontinue using the Service or delete your account through the account settings.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

14. Dispute Resolution

Any disputes arising out of or related to these Terms or the Service shall first be resolved through informal negotiation. If the dispute cannot be resolved through informal negotiation, it shall be submitted to the competent courts of Portugal.

You agree that any legal action shall be conducted on an individual basis and not in a class, consolidated, or representative action.

15. No Waiver

Our failure to enforce any part of these Terms shall not constitute a waiver of our right to later enforce that or any other part of these Terms. No waiver of any provision of these Terms will be deemed a further or continuing waiver of such provision or any other provision.

16. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page and updating the "Last Updated" date.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. If you do not agree to the new terms, please stop using the Service.
